New Annual Parapet Observation Requirement for NYC Building Owners Starts January 2024
In an important update, the NYC Department of Buildings (DOB) has introduced a new requirement mandating annual parapet inspections for certain buildings. Starting January 1, 2024, building owners with parapets facing public areas—like streets, sidewalks, and roadways—must ensure these structures undergo yearly observations. This update aims to maintain public safety and prevent hazardous conditions related to parapets, which are often exposed to weathering and structural stress.
This new regulation applies to most buildings with parapets along public rights-of-way. However, there are exceptions: detached one- or two-family homes and buildings with barriers that prevent public access to exterior walls do not need to conduct these observations. These exceptions allow a more targeted focus on structures with significant public exposure, helping prevent possible hazards.
The NYC DOB has specified that any competent person experienced in assessing parapets can conduct these observations. This includes skilled tradespeople like bricklayers, handymen, and masons, as well as NYS-licensed architects, engineers, and building inspectors. This flexibility in qualification means building owners have a wide range of professionals to choose from, ensuring they can find a qualified person who understands the technical requirements of parapet safety.
The person who performs the observation, or the building owner consulting with them, must prepare a detailed report of the inspection. Importantly, owners are required to keep these reports for six years and provide them to the DOB upon request. This documentation ensures accountability and allows the DOB to track parapet conditions over time, supporting long-term safety for public areas near these structures.
If any unsafe or hazardous conditions are detected during the observation, the DOB must be notified immediately by calling 311 and emailing parapets@buildings.nyc.gov. Additionally, the building owner must take immediate action to protect the public, such as installing sidewalk sheds, fences, or safety netting around the building. Hazardous conditions must be remedied within 90 days, and any required public safety measures must stay in place until the issue is resolved.
