Local Law 77 of 2023: NYC DOB Updates on Post Approval Amendment Fees and License Renewal Deadlines
In accordance with Local Law 77 of 2023, the New York City Department of Buildings (NYC DOB) recently rolled out updates impacting Post Approval Amendment (PAA) fees and the timing for license renewal applications. Effective from July 29, 2023, these changes, implemented in the DOB NOW and eFiling systems, aim to streamline administrative processes while maintaining regulatory compliance across New York City.
One of the notable adjustments is the increase in fees for Post Approval Amendments. Previously, building owners and contractors were required to pay a $100 fee for submitting a PAA, which is a modification submitted after initial approval to amend plans or address changes made during construction. However, as of July 29, 2023, this fee has increased to $130 for all PAA submissions processed through DOB NOW: Build or eFiling. This increase reflects the administrative costs associated with processing these amendments and is part of the NYC DOB’s efforts to keep building fees aligned with current regulatory needs.
This fee change means that those submitting PAAs will need to factor in the updated costs to stay compliant with city regulations. Detailed information on the revised fee structure can be found under NYC Administrative Code Table 28-112.2, which outlines all applicable charges.
In addition to the PAA fee increase, NYC DOB has revised the timeline for submitting license renewal applications. Previously, applicants had a 60-day window to submit renewal applications before their license expiration date. Now, with the recent change, applicants can submit their renewals up to 90 days before the expiration. This extension gives license holders an additional month, which helps alleviate last-minute submissions and ensures that renewals can be processed in a timely manner without unexpected delays.
This adjustment allows license holders to prepare their renewal documents and submit applications with ample time to avoid disruptions in their operations. The full details of this change can be found in NYC Administrative Code § 28-401.12, which provides specific guidance on license renewal timelines.
Both of these updates emphasize the NYC DOB’s commitment to a more organized and streamlined regulatory framework, where building owners, contractors, and other stakeholders can more easily maintain compliance. By adjusting the PAA fees and extending the license renewal submission period, the NYC DOB is responding to the needs of the industry for clearer and more accessible processes. These updates also encourage stakeholders to be proactive in managing their applications, reducing the likelihood of delays or penalties.
