NYC DOB Service Update on Filing Mechanical Systems Work
The NYC Department of Buildings (DOB) has issued a new service notice outlining updated filing requirements for mechanical systems work. These guidelines, effective as of April 4, 2024, are designed to streamline the process and ensure that all necessary permits are filed through DOB NOW: Build, the DOB’s online portal. This update impacts anyone involved in constructing or altering buildings within NYC, especially those handling mechanical systems such as heating, ventilation, and cooling.
According to the notice, any mechanical system work associated with new buildings or alterations must be filed under the “Mechanical Systems” (MS) work type in DOB NOW: Build. This includes systems like heating, ventilation, air conditioning (HVAC), refrigeration, and cooling towers, along with the necessary components such as associated ducts, piping, generators, and structural supports. All work related to the physical setup or alteration of these systems must be documented in a way that meets DOB compliance standards, ensuring that each project adheres to safety and building codes.
For certain mechanical systems that require an Equipment Use Permit, also known as a Certificate of Compliance, this new rule mandates their application through the DOB NOW: Build system. This ensures that all equipment is registered, reviewed, and monitored to maintain safety across NYC’s buildings. Mechanical systems work that does not need a Certificate of Compliance, however, should be filed as part of the General Construction (GC) category. This means that basic elements like structural supports, piping, and ducts will now be grouped with other general construction filings if a Certificate of Compliance isn’t required.
An additional aspect of this update is its specific requirements for residential properties. Starting from May 12, 2020, whole-house ventilation systems became mandatory in all one- and two-family homes within NYC, following energy code standards outlined in the NYC Energy Conservation Code (NYCECC R403.6). This change eliminated previous exceptions, so all ventilation and air conditioning systems for these homes now require an MS work type filing in DOB NOW. This step ensures that every family home meets both ventilation and air conditioning standards, improving overall air quality and living conditions.
