NYC DOB Service Update: Filing Fees for Reinstated Applications with Significant Changes
In May 2024, the New York City Department of Buildings (DOB) announced a new service update addressing filing procedures and fees for reinstating abandoned applications or expired permits. The update applies to cases where applicants intend to continue with the same job number but with significant modifications to the original filing. This change offers a streamlined process for applicants needing to reinstate permits with major revisions, such as design changes, zoning modifications, or new energy reviews.
According to the NYC DOB, an abandoned or expired permit loses its validity post-expiration. However, under the new guidelines, applications with “substantial changes” may proceed administratively under the original job number, provided all associated fees are paid as though it were a fresh application. The goal is to simplify filing for applicants making major updates, ensuring compliance while reducing unnecessary repetition in the process.
Substantial changes, per the DOB, include:
- New design plans submitted by a new applicant,
- Major changes to the zoning lot, use, or bulk,
- Significant occupancy or layout modifications,
- Adjustments requiring a new energy review.
These are situations where the original project undergoes such a level of transformation that standard filing fees apply as if the applicant were starting anew. This ensures the DOB has up-to-date records and thorough reviews for all building plans.
The NYC DOB has laid out specific steps for reinstating applications with substantial changes. Applicants with an incomplete status or existing objections in the DOB NOW portal should resubmit their filing or, if previously approved, submit a Post Approval Amendment (PAA). Here’s a brief overview of the required steps:
- Identify Scope Changes: Clearly indicate in the Comments section of the PW1 form that there is a substantial change in scope, detailing the specific adjustments.
- Plan Examiner Review: A plan examiner will issue an objection, directing the applicant to either refile the job or request administrative continuation via an AI1 form, which must be submitted to the Borough Commissioner’s Office.
- Appointment for Fee Assessment: The applicant submits a PER11 Appointment Request form via email to the relevant plan exam office or NYC Development Hub. The Commissioner’s Office will assess and enter the appropriate fees on the AI1 form.
- Fee Payment and Documentation: After receiving the stamped AI1, the applicant must go to the borough office to pay the fee and upload proof of payment as an Additional Supporting Document in DOB NOW.
This update ensures that all reinstated applications with significant changes are thoroughly reviewed and properly documented.
