NYC DOB Update: New Requirements for Owner Notification of Work Start
The New York City Department of Buildings (NYC DOB) has implemented an important change under Local Law 77 of 2023. Property owners are now required to notify the DOB before beginning any construction work that necessitates a Tenant Protection Plan (TPP). This amendment to NYC Building Code Section 3303.10.2 mandates that notifications be submitted at least 24 hours but no more than 72 hours before the start of such work. This updated requirement aims to enhance safety and accountability for construction projects in NYC buildings.
For jobs filed under the DOB NOW system, owners can submit notifications by logging into the DOB NOW portal. From the dashboard, they should select the “+Notifications” option, followed by “Tenant Protection Plan.” If an owner needs to change the start date after submitting a notification, they can cancel the original notification by selecting the trash can icon under the Action column in the Tenant Protection Plan 72-Hour Notifications dashboard. This streamlined digital process allows property owners to manage their work start dates efficiently.
For BIS (Building Information System) jobs, owners must use a different procedure. Notifications should be submitted through the Owner Notification form available on the NYC DOB website. This alternative option ensures that those working within the older BIS framework can also comply with the new requirements, promoting uniformity across all NYC DOB projects.
This update came into effect on August 1, 2023, giving property owners and project managers ample time to become familiar with the new process and make the necessary adjustments to their project workflows. It’s a step towards improved communication and oversight, especially for work that impacts tenants, as mandated under the TPP.
