NYC DOB Updates: Artwork Now Required on Temporary Protective Structures
The New York City Department of Buildings (NYC DOB) has introduced an update under Local Law 163 of 2021, which requires approved artwork to be displayed on certain temporary protective structures. Effective from September 1, 2023, this law impacts construction sites citywide by mandating that artwork be installed on sidewalk sheds, construction fences, and supported scaffolds that remain in place for more than 90 days. This initiative aims to improve the appearance of active construction sites, adding aesthetic value and contributing to a more visually pleasing city landscape.
Under this new requirement, property owners are responsible for arranging approved artwork to be displayed on these temporary protective structures. This includes selecting either pre-approved artwork or an alternative that meets the standards set by the NYC Department of Cultural Affairs (DCLA). The approval process begins in DOB NOW, NYC DOB’s online portal for building permit applications, where property owners are prompted to answer whether they wish to comply with or opt out of the artwork requirement.
For property owners who opt to display artwork, the application process will require uploading a DCLA Approval of Artwork Required Document, certifying that the artwork meets DCLA standards. For those who have not yet secured approval but plan to comply, the law permits an initial opt-out, with the possibility of amending their application once DCLA approval is granted. This flexible approach ensures that property owners have time to obtain the necessary documentation without delaying ongoing projects.
Not all property owners have the option to opt out. City-owned properties and properties that receive capital funding from the city are typically ineligible to opt out of the artwork requirement, as these properties are mandated to comply in full. This inclusion highlights the city’s commitment to transforming all areas under its jurisdiction into vibrant and engaging public spaces, even during construction phases.
