The DOB has recently issued a service notice concerning the failure to file annual boiler inspection reports for the years 2018 through 2021. Understanding the DOB Service Notice
The DOB has announced that it will be issuing violations by July 2023 for any failure to file these annual boiler inspection reports. These violations will remain on the properties until civil penalties are either waived or paid, and current inspection reports have been filed.
How to Address Violations and Penalties
If you’ve missed filing your annual boiler inspection reports, don’t worry. The DOB has provided a clear process for making payments or requesting to waive civil penalties through DOB NOW: Safety. To access DOB NOW, you’ll need an eFiling account, which can be created at nyc.gov/efilingtips.
To search for violations and make payments, follow these steps:
- Select DOB NOW: Safety and then the Violations portal.
- From the dashboard select +Violations Payments and then Boilers.
- Search by violation number, device number, address, or BIN. Select the device number, click +Add, and then Save the application.
- Complete the Statements & Signature section and then select Proceed to Pay to complete the payment.
Remember, only one violation can be paid per application, and the violation will not be dismissed unless an accepted current annual boiler inspection report has been submitted by a licensed professional in DOB NOW.
Requesting a Civil Penalty Waiver
For those wishing to request a civil penalty waiver, the process is as follows:
- Select DOB NOW: Safety and then the Violations portal.
- From the dashboard select +Civil Penalty Waiver and then Boilers.
- Search by violation number, device number, address, or BIN. Select the device number and then select up to five violations and click +Add.
- Select the Waiver Request Reason and then Save the application. For waiver information, see 1 RCNY §103-01 and §103-05.
- Upload any required supporting documentation on the Documents tab.
- Complete the Statements & Signature section and Save the application again.
- Select the Pay Now button to submit the payment of $30.00 in the CityPay portal.
Once the request is submitted, an email notification will be sent with the status of the review. If the waiver is granted for all of the violations on the device, the violation status in BIS will be updated to dismissed.
Payment Methods
All payments are made in DOB NOW and can be paid by eCheck, credit card, PayPal, or Venmo. There is a 2% surcharge for credit card, PayPal, and Venmo payments. Payments made by eCheck may take up to 10 business days to process. Please note that in-person and mail-in payments will not be accepted.
