NYC DOB Boiler Violations Update: Requirements and Penalty Information
In a recent service update, the New York City Department of Buildings (NYC DOB) announced that starting November 2023, it will issue violations for properties with unaddressed defects reported in high- and low-pressure boiler inspection reports from 2018 to 2022. These violations, applicable to property owners who failed to file an affirmation of correction for the specified years, underscore the importance of addressing and rectifying any past-due boiler inspection corrections.
Violations remain on record until two actions are completed: the associated civil penalties are either paid or waived, and a licensed professional submits a current affirmation of correction through DOB NOW: Safety. The fee per boiler inspection violation is $1,000, which must be processed online via DOB NOW: Safety, as no in-person or mail payments are accepted. The update directs users to use an eFiling account to log in and manage their payment and violation information.
Property owners should navigate to the DOB NOW: Safety portal and select the Violations section to view and pay for violations. From the dashboard, users can add specific violations by searching via device number, address, BIN, or violation number. Payment options include eCheck, credit card, PayPal, or Venmo, though a 2% surcharge applies for credit card, PayPal, and Venmo transactions. Note that eCheck payments can take up to 10 business days to process.
The DOB NOW portal provides a dedicated process for property owners seeking a waiver of the civil penalties. After selecting up to five violations related to a single boiler device, applicants must specify the waiver request reason, upload the necessary documents, and submit the application. Each waiver request incurs a $30 fee, paid through the CityPay portal. If approved, the violation status updates to “dismissed” in DOB NOW: Safety.
It’s important for property owners to understand that any boiler violations from November 2023 onward are exclusively accessible through DOB NOW: Safety, as these records will not be available in the Building Information System (BIS).
