NYC DOB Construction Codes Fee Changes Effective December 2023
The New York City Department of Buildings (NYC DOB) has issued an important update regarding fee changes for specific documents, including the Letter of No Objection (LNO)/Letter of Verification, the OP 128: Ordinary Plumbing Work Report, and temporary use letter renewals. These changes will come into effect on December 4, 2023, aligning with NYC Administrative Code §28-112.8. This update is essential for construction industry professionals, building managers, and property owners who require these documents for compliance and regulatory purposes.
Starting December 4, the fee for obtaining a Letter of No Objection (LNO) or Letter of Verification will increase from $100 to $130. This fee applies to buildings other than one-, two-, or three-family homes and is used to classify the occupancy of a property for regulatory purposes. These letters must be paid in person at the relevant borough office.
The fee for filing an OP 128: Ordinary Plumbing Work Report will also rise from $100 to $130. This report covers ordinary plumbing work that does not need a full alteration permit. It must be submitted to the NYC DOB’s Limited Alteration Applications Unit at 280 Broadway, 1st Floor, New York, NY 10007. Reports submitted with outdated fees after the implementation date will be returned, so it is important to confirm the correct payment amount before submitting.
The update further impacts temporary use letter renewals. Fees for these renewals, issued to authorize the temporary use of specific areas within a building, will increase from $100 to $130 for each additional 30-day period. This fee increase applies only to renewals, as the initial filing fee remains $100. Payments for temporary use letter renewals must also be made in person at the borough office where the letter was initially filed.
