NYC DOB Extends Deadline for Building Emissions Adjustment Applications
In an important update, the New York City Department of Buildings (NYC DOB) has extended the deadline for applications to adjust annual building emissions limits. This extension affects applications for the calendar years 2024-2029 and gives building owners and managers more time to comply with Local Law 97 of 2019, which sets emissions standards to improve city-wide sustainability.
The extended deadline means that applications for emissions adjustments under NYC Administrative Code §28-320.8 and §28-320.9 must be submitted through the DOB NOW: Safety portal by January 1, 2025. This additional time offers building stakeholders a chance to gather necessary documentation, understand the requirements, and apply without the pressure of an immediate deadline.
The extension applies specifically to two main categories:
- Excess Emissions Due to Special Circumstances: Buildings emitting at least 40% more than the 2024 limit due to unique situations can apply for an adjustment under Section 28-320.8. For this category, applications must be submitted by the January 1, 2025 deadline, with a filing fee of $2,450.
- Not-for-Profit Hospitals & Healthcare Facilities: Nonprofit hospitals and healthcare facilities facing challenges in meeting emissions standards can apply for a reduced-fee adjustment under Section 28-320.9. Their deadline is also January 1, 2025, but with a lower filing fee of $335. This aims to ease the burden on essential health services as they work towards sustainability goals.
