NYC DOB to Enforce Violations for Missing Elevator Test Reports (2018-2022)
In August 2023, the New York City Department of Buildings (DOB) will begin issuing violations for properties that failed to submit the required Category 1 elevator test reports from 2018 to 2022. This enforcement measure is essential for maintaining safety standards across the city, emphasizing the importance of timely elevator inspections and report filings.
Building owners should note that these violations will remain on record until the required test reports are filed and any resulting civil penalties are either paid or waived. To clear a violation, property managers must submit current Category 1 test reports through the DOB NOW: Safety online portal. This digital platform is designed to streamline compliance processes, allowing users to manage violation payments and waiver requests more efficiently.
For those facing these violations, DOB NOW provides clear instructions for making payments. Users can log in via their eFiling account on nyc.gov/dobnow. If you need an eFiling account, set up is available at nyc.gov/efilingtips. Once logged in, navigate to the Violations portal, select “Elevators,” and proceed with the payment by adding the specific violation number and completing the necessary steps. Note that only one violation can be paid per application.
For building owners looking to waive civil penalties associated with these violations, the DOB NOW portal also facilitates waiver requests. Users can apply for a waiver based on specific reasons, such as documented hardships or other qualifying circumstances as outlined in 1 RCNY §103-02. Each application can address up to five violations per device, and supporting documentation may be required. Once submitted, users will receive email updates on the waiver review status. If the waiver is approved, the violation status in DOB NOW will be updated accordingly.
Payments can be made through various methods, including eCheck, credit card, PayPal, and Venmo, although a 2% surcharge applies for certain methods. Note that payments made via eCheck may take up to 10 business days to process, and in-person or mail-in payments are not accepted.
