NYC DOB Update: Civil Penalties for Retaining Wall Compliance Report Filing
The New York City Department of Buildings (NYC DOB) has recently issued an update regarding civil penalties for property owners who do not submit their retaining wall compliance reports on time. This notice, adequate starting October 1, 2024, emphasizes strict penalties for missed deadlines, aiming to ensure timely reporting and maintain building safety across New York City.
Property owners must submit an acceptable retaining wall compliance report for each inspection cycle, with Cycle 3 underway. The NYC DOB has set clear deadlines for different boroughs, stretching from December 31, 2024, to December 31, 2028, depending on the borough.
Property owners who miss the filing deadline will face a $1,000 yearly penalty starting January 1 following the missed deadline. Additionally, those who file late will incur an extra $250 monthly penalty beginning February 1 until the report is filed.
To resolve any penalties, property owners should follow these steps:
- Request a Penalty Sheet: Owners must request a penalty sheet by emailing LL37RetainingWalls@buildings.nyc.gov and attaching a copy of their accepted report.
- Pay the Penalty: Penalty payments can be made at the Central Cashier at 280 Broadway in Manhattan. Acceptable payment methods include credit cards, certified checks, cashier’s checks, and money orders.
- Submit Proof of Payment: A copy of the payment receipt and penalty sheet must be sent to .
- The DOB will dismiss the violation upon submission of an approved report and payment.
Suppose property owners believe they have grounds to challenge the penalty. In that case, they can submit proof of compliance, evidence of wall removal, or an accepted RWIP-11 form indicating the wall is not subject to NYC DOB regulations.
Property owners who request a full or partial penalty waiver can provide proof listed in 1 RCNY 103-09(j) to LL37RetainingWalls@buildings.nyc.gov.
