NYC DOB Update: Construction Superintendents Limited to Three Jobs Starting 2024
The New York City Department of Buildings (NYC DOB) has announced a new limitation for Construction Superintendents (CS) under Local Law 149 of 2021, effective January 2, 2024. This regulation will limit each CS to three active job permits. Previously, superintendents were allowed to manage up to five projects, but with this change, individuals must reduce their active projects to a maximum of three, enhancing focus and safety on each site.
The new rule also includes a specific stipulation for major building projects. If a CS is assigned to a major building, defined by NYC DOB standards, they can only serve as the primary CS for that project alone and no others. This ensures a dedicated level of supervision for larger, more complex projects, potentially reducing risks associated with managing multiple high-demand sites.
For superintendents currently designated on more than three jobs, NYC DOB has outlined a process to either withdraw from or change designated jobs as follows:
1. Withdraw a CS from a Permit:
- For jobs handled through DOB NOW, superintendents can withdraw by selecting “Withdraw Site Safety Stakeholders” under the Work Permits dashboard.
- For BIS (Building Information System) jobs, superintendents need to submit a signed letter of intent to withdraw to the relevant Borough Commissioner’s Office.
2. Change the CS on a Permit:
- On DOB NOW, the permit applicant can renew with a change of CS at any time.
- For BIS jobs, the applicant must submit a PW2 form at the Borough Office for renewal with change. Permit renewals with changes cannot be processed through eFiling, which remains an important note for stakeholders in the construction field.
3. Requesting Release of Site Safety Requirements: For guidance on site safety release procedures, the NYC DOB recommends reviewing the details in their July 8, 2022, Service Notice. This process is essential when a CS wants to request a release from site safety responsibilities.
This change aims to increase safety and accountability across construction sites in New York City, ensuring each CS dedicates more attention and resources to a limited number of projects. As the deadline approaches, the NYC DOB has encouraged all construction superintendents to take proactive steps to comply with the new guidelines.
