NYC DOB Updates Street Tree Checklist for Building Exemptions
In a recent update, the New York City Department of Buildings (NYC DOB) has revised its ST1: Street Tree Checklist, introducing a new exemption criterion for proposed construction projects. This change is part of the department’s efforts to streamline compliance with zoning regulations while balancing environmental sustainability needs.
Starting May 31, 2024, NYC DOB will no longer accept the older version of the ST1 Checklist dated (Rev. 8/16). Instead, applicants must use the newly updated form with “Rev. 5/24” in the lower right corner, which is available for immediate use. This form helps project applicants determine if their work is exempt from NYC’s street tree requirements, which aim to maintain and increase green space in the city.
The primary addition to the updated form is a new exemption option for certain projects. Now, applicants can certify that their work is not establishing a “new open use.” This exemption aligns with Zoning Resolution (ZR) sections 23-03, 24-05, and 33-03, providing clarity on when projects are not required to meet the street tree requirements. Specifically, if the proposed work does not create a new open area, such as a parking lot or open space, it may qualify for this exemption.
This addition is especially helpful for projects that may expand existing structures or adapt older buildings without significantly altering their exterior spaces. Other exemptions remain in place, including those for projects that do not exceed certain floor area thresholds or involve detached garages above a specific size.
