Are you planning a construction project in NYC? If so, it’s crucial to be aware of the new Local Law 109 of 2022, which mandates rodent abatement during construction. NYC’s New Rodent Abatement law, effective from May 18, 2023, requires a licensed exterminator to treat the premises for rodent extermination for specific types of construction work.
The law applies to:
- Construction work involving 50% or more of the floor area of a building
- Vertical or horizontal enlargement increasing the building floor area by more than 25%
- Demolition of more than 50% of the floor area of a building
- Full demolition of a building
From June 6, 2023, permit applicants will need to certify that a licensed exterminator has been retained to effectively treat the premises for rodent extermination as per the requirements of the NYC Department of Health and Mental Hygiene (DOHMH).
Full demolition permits will require applicants to certify on the PW2 that a licensed exterminator has been retained. They will also need to submit a Rodent Control Required Item/Document prior to permit issuance.
For more detailed information, you can view the actual notice on the NYC Department of Buildings website.
